Fatal Pedestrian Accidents in Maryland
Fatal car crashes take the lives of hundreds of people every year in Maryland. Unfortunately, there are many instances where pedestrians are involved in these crashes. Far too often, fatal pedestrian accidents are caused by some form of negligence.
Leading factors in fatal pedestrian accidents that we see here in Maryland include:
- Distracted drivers
- Nighttime visibility issues
- Speeding drivers
- Drunk driving
- Failure to yield at crosswalks
These and other negligent actions continued to take the lives of innocent people across our state. After losing a loved one due to a fatal accident, surviving family members are able to file a legal claim against the responsible party. These claims are designed to provide financial relief for some of the losses and damages that bereaved families face. Some of the damages that are able to be recovered include:
- Loss of companionship and emotional support
- Pain and suffering of the deceased before passing
- Loss of financial support and future earnings
- Medical and funeral expenses
- Loss of inheritance and benefits
- Punitive damages, in some cases
When it comes to recovering compensation for damages following the loss of a loved one, Maryland follows a strict contributory negligence standard. This means that if an injured person is found to have contributed in any way to the accident or their injuries, even minimally, they can be barred from recovering any compensation from other parties involved. For this reason, it is critical that you seek guidance from my Brandywine wrongful death lawyer immediately. Your attorney will be able to create the strongest case possible against the defendant to prove that your loved one contributed in no way to the accident.
